2. Use of This Website


You agree to use this website lawfully and not to:

All services are provided subject to an agreed quotation or proposal.
Each project may include its own scope of work, timelines and pricing.
Any work requested outside the agreed scope may incur additional charges.
 

4. Quotations


Unless otherwise stated:

  • Quotations remain valid for 30 days.

  • Prices are in GBP (£).

  • VAT will be added where applicable.

 

5. Payments

 

Invoices are payable within the agreed payment terms stated on the invoice.
Late payments may result in:

  • Suspension of ongoing work.

  • Delayed project completion.

  • Interest charged in accordance with the Late Payment of Commercial Debts (Interest) Act 1998 where applicable.

 

6. Client Responsibilities

 

Clients agree to:

  • Provide accurate information.

  • Supply requested content promptly.

  • Obtain any necessary permissions for supplied images, logos and materials.

  • Review and approve work within a reasonable timeframe.

Delays in providing information may affect project deadlines.

 

7. Website Design

 

Unless otherwise agreed:

  • Ownership of the completed website transfers once full payment has been received.

  • Mush Media may showcase completed work within its portfolio.

  • Clients are responsible for ongoing website updates unless covered by a maintenance agreement.

 

8. SEO Services


Search Engine Optimisation is an ongoing process.
Mush Media cannot guarantee:

  • Specific Google rankings

  • Increased traffic

  • Sales or enquiries

  • Search engine indexing

Search engine algorithms are outside our control.


9. Social Media Marketing


While we aim to maximise engagement and growth, we cannot guarantee:

  • Follower numbers

  • Reach

  • Engagement levels

  • Sales

  • Leads

Platform algorithms frequently change and remain outside our control.

10. Intellectual Property


Unless agreed otherwise:

  • Mush Media retains ownership of concepts, templates and working files.

  • Clients receive ownership of completed deliverables once payment has been made in full.

  • Third-party assets remain subject to their respective licences.

 

11. Third-Party Services


Projects may use third-party providers including:

  • Hosting companies

  • Domain registrars

  • Google services

  • Meta platforms

  • Analytics software

  • Plugins

Mush Media is not responsible for outages, changes or failures caused by third parties.


12. Limitation of Liability


To the fullest extent permitted by law, Mush Media shall not be liable for:

  • Loss of profits

  • Loss of business

  • Indirect losses

  • Consequential damages

  • Website downtime caused by third parties

Our total liability shall not exceed the amount paid by the client for the relevant service.
Nothing in these terms excludes liability where it cannot legally be excluded.

 

13. Cancellation


Either party may cancel ongoing services by giving reasonable written notice unless otherwise agreed.
Work completed up to the cancellation date will remain payable.
Deposits are generally non-refundable once work has commenced.


14. Privacy


Your use of this website is also governed by our Privacy Policy.


15. Governing Law


These Terms & Conditions are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
